NLRB Prepares to Issue a Complaint Against Dallas Black Dance Theatre with Nearly 20 Allegations of Unlawful Conduct

October 28, 2024
AGMA has been notified that the NLRB is preparing to issue a complaint against Dallas Black Dance Theatre with nearly 20 allegations of unlawful conduct, including the termination of the main company dancers. DBDT has also received this notification.

The complaint will proceed absent a settlement agreement with DBDT. So, we will keep everyone updated on that front. This is a milestone victory for the dancers who were unlawfully terminated after unionizing; it validates everything we’ve known since the beginning.

In light of this, here’s the full memo we sent to DBDT’s legal team today:

Re: October 29 Meeting

Dear Emily, Amanda, and Hannah:

The American Guild of Musical Artists (“AGMA”) has been advised that the National Labor Relations Board (“NLRB”) is prepared to issue a complaint and recommend seeking injunctive relief in federal district court over Dallas Black Dance Theatre’s (“DBDT”) termination of the entire main company and many other allegations of unlawful discrimination. We have informed the Dallas City Council about the forthcoming NLRB complaint and the recommendation to pursue emergency relief in federal district court.

We understand that the NLRB has given DBDT a deadline of October 29, 2024, the same date we are scheduled to meet, to advise whether it is interested in settling this matter. We can meet as scheduled if you are prepared to resolve the pending legal matter.

Otherwise, we will postpone our meeting until there is clarity about your position regarding settlement. Our team is available to meet from 2 to 4 PM Eastern on November 6, 2024. Please advise.

Sincerely,

Martha Kinsella
